Oklahoma Attorney Predicts Billions of Dollars in Darvocet Lawsuit Recoveries
NewsOK is reporting that Oklahomans took nearly 15 million propoxyphenepills last year, and, according to one local attorney, recoveries from upcoming Darvon and Darvocet lawsuits could be in the billions of dollars.
Matthew J. Sill of Sill & Medley, an Oklahoma law firm with offices in Edmond and Shawnee, acknowledges that litigation stemming from the FDA’s recall of all products containing the pain reliever propoxyphene, known best as Darvon and Darvocet, is still in the early stages, but “has the potential to be in the billions of dollars for recoveries around the country.”
Sill says that the majority of inquires he receives about propoxyphene have to do with deaths caused by the drug. According to autopsy reports, propoxyphene was responsible for the deaths of 112 Oklahoma residents between 2006 and 2010. Records show that 37 Oklahomans died from using the opioid pain reliever in 2009 alone.
NewsOK also relates the story of Oklahoma City resident C.J. West, who was prescribed Darvocet last year to deal with the pain of a spider bite. After using the drug for ten days, she suffered a stroke. The incident was not actually West’s first negative experience with Darvocet. She also took the pain reliever in 1996 following a car accident and had a major stroke. Said West, who had to relearn to talk and gave up her teaching job due to her struggles with memory lapses, “I’m not a smoker, not a drinker. I’ve never done illegal drugs and certainly didn’t abuse Darvocet.”
West, if she chooses to file a claim against Darvocet manufacturer Xanodyne Pharmaceuticals, and barring a pre-existing heart condition, is the type of patient who is likely to be successful in a Darvocet lawsuit. As Sill notes, propoxyphene litigation is in the early stages, making it impossible to accurately predict how many cases will be filed and what the specific grounds for a Darvocet lawsuit are.
